Microsoft wins a small battle in Vista Capable lawsuit

Judge Marsha Pechman has ruled that the lawsuit against Microsoft related to their “Vista capable” marketing program cannot be qualified as a class action suit.

This means that customers would have to file individual cases against the company if they want to seek damages from the US based software giant.

The ruling said: “Absent evidence of class-wide price inflation, Plaintiffs cannot demonstrate that common questions predominate over individual considerations.”

This is a major victory for Microsoft as they are not going to be penalized a huge sum if they had lost the class action lawsuit.

Microsoft had this to say on the new developments: “We’re pleased that the court granted our motion to decertify the class, leaving only the claims of six individuals. We look forward to presenting our case to the jury, should the plaintiffs elect to pursue their individual claims.”
